NEW: Perry man arrested in friend's shooting death

PERRY, Okla. — A 23-year-old man is dead after drunken wrestling turned ugly, Perry police said Monday.

Perry man Shane Allan Rupp, 23, is being held in the Noble County Jail on complaints of first-degree murder, using offensive weapon in a felony, cultivation of a controlled substance and manufacturing a controlled substance with intent to distribute. He is being held in the Noble County Jail without bond.

Rupp had not been charged Monday morning and his first court appearance had not been scheduled.

Donny Tally, 23, of Perry, died after he was shot in the head Sunday night, Perry police Capt. Jim McIlvain said.

Police went to a house at 1125 Fir St. just after 9 p.m. Sunday, McIlvain said. A woman called police “crying hysterically” and said a man shot another man in the head, according to a Perry police activity summary.

A man and his long-time friend were wrestling in the living room when one of the men got angry and grabbed a .9mm pistol from a bedroom and “shot his friend in the head,” McIlvain said.

Witnesses told police Rupp got the gun from his dresser in his bedroom, McIlvain said.

“He talked about owning a gun earlier that day,” McIlvain said.

Tally died at the scene. Rupp was arrested at the house, McIlvain said.

The men had been drinking and wrestling around all day, McIlvain said. A sample of Rupp’s blood was taken to determine if he was intoxicated at the time of the shooting, McIlvain said.

Police also reported finding marijuana growing in the home, McIlvain said.
