Judge overrules motion to dismiss Oklahoma State fall victim lawsuit

STILLWATER, Okla. — A lawsuit alleging the construction of Boone Pickens Stadium contributed to a woman's death will move forward after Oklahoma State University's motion to dismiss the case was overruled by the court.

Charlotte Mayfield, 66, died from head injuries sustained from falling backward down a set of stadium steps Dec. 9, 2011. She was there to watch her grandson’s Class 3A championship football game. Her husband, Ronald, filed suit against the school.

The school's main argument for dismissal was that OSU has sovereign immunity from prosecution when participants in athletic contests are injured. The decision came down to whether or not Charlotte Mayfield, a 66-year-old woman, could be considered a participant in the game.

Judge Philip Corley overruled the motion to dismiss the case, saying the main issue will be whether or not the school was negligent.
